Disabled Workers' Rights Under the Law of Employment Discrimination - Know your rights
The Americans with Disabilities Act of 1990 was enacted to prevent dicrimination by employers against disability, or to use a new phrase, people with disabilities, people. This law gives certain rights to the disabled, already question of recruitment, pay, promotion or dismissal. ((In addition, employers are encouraged to employ, to give them an incentive, or what is required hire a certain percentage of its work force.)).
What are these rights, their scope, when it may be worth and what remedy available?
First, please note that this legislation against discrimination applies only to those companies that emloy 15 or more people. This includes state and federal agencies and employment agencies, and even unions. (?)
The Commission appointed to the Law, namely that of Equal Employment Opportunity Commission (EEOC) defines a disabled person as someone who
• Has a physical or mental impairment that substantially limits one or more major life activities;
• Has a record of such impairment, or
• Is regarded as having such impairment
It reproduce, moreover, that the person should be able to perform the functions of a position of "reasonable" or not, the accommodation provided by the employer. What is reasonable accommodation? Again, the EEOC comes to the rescue in the definition of this term. It includes making the existing workspace or space "accessible and usable" for people with disabilities, job restructuring, changes of schedules, reassigning the worker question to another vacant post, modify devices or the purchase of equipment, devices, materials used for training, and interpreters who provide or readers may be required.
It is also important to understand that this is not an unfettered right. In order not to create rights that impinge on other employers are exempt from duty if they can show cause that these rules were too burdensome, they are subject to limited financial resources, or limit their physical space of operation, or cause a reduction in productivity, or lower quality standards in the manufacture of this type of accommodation.
Medical examinations investigations are forbidden to be imposed only to persons with disabilities. Employers are barred from asking about disabilities, their existence, severity, etc. Without But they can and have the right to ask about the ability to perform the required functions, and may have to take a test, provided that the other applicants, no apparent disability are also required to perform the same process. In other words, what applies to ordinary workers would apply equally to persons with disabilities well.
The remedy for any violation of these rules and regulations under the Act are in a civil suit for damages and reinstatement. The burden of proof lies with the person submitting the application, and the general rules for the discovery of evidence in the Civil Code apply.
No laws provide shelter for people with alcohol or illegal drugs. drug use or alcoholism. You do not protect people with disabilities were the employer to request these tests, provided that the same tests that apply to people with normal abilities.
