Under Seat

"The failure back seat" a life-threatening defect
"Failed back seat" is a potentially fatal flaw many cars, causing many injuries and deaths each year. There are estimates that in 1990 there were 1,100 deaths and 1,600 serious injuries due to collapse in the back seat of composition collisions. These injuries could have been avoided if the seat back design was replaced by proven security measures that have been readily available for decades.
The problem is that the national safety standard does not have adequate seat strength and many manufacturers prefer to install the cheapest, most dangerous seats in lower-priced lines of cars and trucks safer than the more expensive seats. Every American car manufacturing has had complaints about lack of security again.
no seat backs under various circumstances. However, the ultimate cause of these failures is the collapse of the back seat behind the body mass of an occupant. Some seat backs fail due to the acceleration of this mass in a collision, while others fail under the weight of the occupant when the vehicle is stationary or traveling at a constant speed.
The two most common types of failure are lack of seat support system for maintain an upright position and the deformation of the seat frame itself. Failures have been attributed to deformation of the mounting system that contains the seat floor of the vehicle or a collapse of the vehicle floor pan are less common. Another problem is the separation of adjustable head restraints during an accident.
When a vehicle is hit from behind, the impact forces drive the vehicle forward and the occupants are thrown backwards. The seat must be able to keep the occupants safety by keeping the individual from strike to ejection and the internal components or other passengers. If designed properly, the seat back must be the occupant in an upright position secured. When it collapses back to back in an accident, many serious diseases are presented:
- The driver may lose control of the vehicle if you can not sit upright while the vehicle is moving, multiple collisions and more injuries
- Partial or complete ejection of the vehicle when the occupant has slipped below the seat belt
- Interior impacts on the occupant in the vehicle interior structures or other occupants
- A front seat collapse could cause serious injury or death to the occupants of the seat trapped under the seat back collapsed again
- Blocking the exits in case of a broken fuel system caused a fire
Not may have catastrophic results of failure back seat. The injury to the occupants of the seats collapsing often include devastating or fatal head injury spinal cord. These injuries occur when the passenger seat collapses and allows the occupant to strike the back seat or the B-pillar in the back seat. The injuries seat occupants after a collapse often occur when the occupant strikes collapsing seat passengers sitting right behind the collapsing front seat. The contact between the two occupants often results in death or devastating head or chest injuries.
The safety standards for car seats are seen as too lenient and has not updated to protect vehicle occupants otherwise the formation of preventable injuries. Car seats are only required to pass a strength requirement. They are not required to pass through a system crash test rating though backups are failing to National Highway Traffic Safety Administration (NHTSA) 30 mph rear impact tests (FMVSS 301). The risk of rear seat failure stems from a lack of Federal Motor Vehicle Safety Standard (FMVSS) 207 - Seating Systems. This rule Current has not been updated in over thirty years. Requires that a seat must withstand a force of 3,300 inch-pounds applied to seat back in a direction back.
The NHTSA has been petitioned numerous times to strengthen its existing standard. They have received complaints from backups collapse more than two dozen of different cars, including models made by all the U.S. automakers. The standard is so poor that most of the petitioners are demanding an increase of at least six times. This would increase the attraction of a seat must withstand 3,300 inch-pounds to about 20,000 pounds an inch.
Ford Motor Company has been aware of the dangerous seats for over 30 years. This deadly problem was investigated by Ford in 1992, and the result was that the seats of causing serious damage in case of rear-end collisions. The Ford Motor Company did not make any design changes to address the seriousness of the lack of support.
Bisnar | Chase represented a mother of a seven year old girl who died as a result of a failure of support. The complainant and her daughter were rear-ended at 25 miles per hour while in a Ford Escort. As a result of defective seats, the mother's head struck the daughter in the chest, causing the heart of the daughter to rupture and hemorrhage internal. She died a day later.
In 2000, another Ford Escort was in an accident on the back that caused the death of a man. When the Ford Escort was struck from behind, the driver's seat collapsed backwards, throwing him in the rear of the car cabin. The man was fatally wounded by the impact of interior rigid car.
The Ford Explorer is another model of Ford that has had a history of injury to the seat back collapse. Our client was in an accident when his rear seat back collapsed their expulsion in the rear of the vehicle. The impact broke the spinal cord and left her paraplegic.
Almost every front seat produced by General Motors Corporation (GM) from 1970 to mid-1990 was designed to close back in case of collision which was a change in speed of 15 miles per hour or more. According to documents obtained by CBS for his series on the seats of collapse in the back of a collision in 1992, lawyers for GM executives said the standard seats could not be defended.
GM knew as early as 1966 that the security force is directly related to the safety of occupants in rear impact crashes. They have learned that survival depends largely on the occupants a structure that holds the seat front passenger in an upright position, however, have not been upgraded seats. A senior GM engineer, David C. Viano, a 1994 internal study by GM, projected that 376-470 lives could be saved each year and improvements are estimated to prevent 1000 serious injuries every year in rear-end collisions, if the company strengthened its support of the seats.
DaimlerChrysler has been known to collapse seats too. In 2001, one mother, one of our client, a leading manufacturer of minivans, and was expelled from the seat during an accident due to the background collapse. The seat collapsed caused to fatally strike the mother of his child eight months old, which was in a car seat behind her.
